6mm cable 40amp breaker. 8.5kw shower

Did a condition report today found an 8.5kw shower on 40 amp breaker with 6mm cable. It's ran through wooden box section from fuseboard to bathroom so in free air but I then thinks its been chasedinto the wall as it enters the bathroom. Do you think this requires a code?

That's what I thought but what if it's chased into the wall behind tiles? Does that still count as clipped direct?

as long as the wall is not thermally insulated.

the worst case method applies, which is the bit where its chased in, i would apply code 2, or replace the 40a to a 32a breaker to protect the cable,

8.5 KW would draw a maximum of 37 amps (8500/230=36.96) and it's not going to be used to it's full capacity and I would therefore leave it on a 32 A MCB.

With teletrix. Definition says. Where the cable is fixed or embedded in a masonry wall the current carrying capacity may be higher. Masonary is described as brickwork concrete, plaster and similar but not thermally insulated. No code

Could always run the shower for 30mins and put a clamp meter on it just to see what its pulling?

I would be more concerned about the wooden frame on the CDU which i would code a C2 seen loads of these catch fire or get dam close
