6mm main earth on tns

Would you fail a property if it had a 6mm main earth with no visible damage to overheating?

Probably get shot down as Ive left green book at work, but Best Practice guide says.." inadequate cross section ........where conductor less than 6 mm or evidence of thermal damage." This would be code 2. So Im saying 6mm no thermal damage, Code3 Improvement recommended.
