HI all,

can a phone call from a friend of a friend.

Hes and old boy and upset as he thinks he's been ripped off

dont know to much at the moment so basically asking you guys whats his best course of action.

im going to see the system tomorrow but what hes telling me over the phone it seems he might have a working system as the meter is going up

he paid £8100 for the system (size unknown)

he cant get it touch with them to get the FIT payments they are not answering calls.

i wont put up the company yet but will have a look.

im just asking the the moment where should he turn to?.

Hi guys

been round, he has what looks like a working system, i bit rough but working

got a few photo's to put up, company no where to be seen, dont know what panels they have put up but there are only 8 on two different roof positions 45 degrees from each other and 1 string

he's getting nowhere with MCS or REAL, they just say he needs the cert, police cant do anything either. he also took out finace with HITACHI no contract no signiture, money went into his account and he paid the solar firm, firm is worldwidesolar

not sure what i can do for the fella, dont know him really but would love to help out if i can, ill try and upload photos below
 
If it hasn't got module-level optimisation, such as Enphase or Solar Edge, it's going to under-perform due to the mixed orientations.

I'm afraid he's been badly ripped off. The price is extortionate and the system design is probably pretty appalling.

There's no company on the MCS installer db with that name now. When was the installation done? If they were never MCS registered then he is probably out of luck as far as MCS and RECC are concerned.

Did you mean 2 x 8 panels for 16 total or just 8 total? Either way for £8100 he has got a very expensive system. Did he ever have a quote in writing?

How did he pay the firm, by cheque? He must have some paperwork for the loan, maybe try going to CAB.

If he was led to believe that he could claim FiTs and the system installed is not eligible then he may be able to claim fraud and the police should be interested in that.

He needs to seek legal advice before doing that. He could end up in default and it would be bad news for his credit rating and could land him in big trouble.
 
are they standard sized modules, ie approx 1m x 1.65m?

If so then no there is no chance they're 500Wp modules, afaik the highest rated module of that sort of size is 333Wp, so he's been completely lied to if that was the case - outright fraud.

I'd think that's miss selling of the loan as well, in which case there could be some joy with hitachi if he starts using the words 'financial ombudsman'... How to take a complaint to the Financial Ombudsman Service - Which?
 
Sounds like the best advice, is to go and get some advice from a solicitor. Seems as if he's been sold a system, way over than the above normal price. Consumers Rights Act 2015, was he sold product other than at installers premise? Then he should of been informed of his rights to cancel in 12 days, 1 year & 12 days if not given written confirmation. Credit agreement, right to cancel. Times pressing. Go to a solicitor and seek advice, money well spent!

That sounds like a personal loan, so hitachi will probably have nothing to do with it and I doubt you will get any truck from them at all. If the ££ had gone direct to the installer, that's a very different matter.

One key thing is was the contract for the PV direct with the installer? (think MCS..) if not and it was with a 3rd party non MCS certified firm, then he may have a chance.

The price he paid will simply be caveat emptor and I doubt he will have any recourse.

With the timescale re the closure of the FiT, I don't hold out much hope at all. It is likely by the time it's resolved the FiT will be closed, so, he'll be looking for a court action to either reclaim the installation cost, the loan repayment cost or loss of FiT income, however the real danger is that by that time the company will have folded and there will be no-one to take to court.

To achieve anything it needs two days on the phone, driving round various places, involving the local press and TV , and not giving up. PLUS all the facts need to be brought together, records of and dates and times of meetings, correspondence, contract, actual make and size of panels and inverter installed etc.

The date of the contract is critical ( Consumer Rights Act 2015 - Which? )

ELSE, you'll be scrabbling around to find that information and be way too late by the time its pulled together.

Thanks for the reply's guys, i think he;s given up already, cant blame him really i know a bit about it as i used to do it and i dont know where to start. seen a post on facebook about this company also but searched for it and its gone. Mrs said its something to do with slagging off a company on facebook isnt allowed and it was taken down, would have been good to get them together i suppose,
