My friends are ready to exchange their house but have been told they need to either replace the down lights in the top floor ceiling(below the loft) to fire rated spots or get smoke hats for each.
I thought top floor spots didnt need to be fire rated when the is no escape route or livable space above?

Electrical regs ...no
Building regs maybe... some lofts are open through and the fittings will have breached the fire rating of the ceiling so any breach will by a fitting will have to still give the fire rated value of the original ceiling.

Secondly - its a report for house sale there is nothing forcing the existing owner carrying out any recommended works only to reflect any works needed in the price..

When I bought my house it needed a full rewire which was not on any spec of sale ... I did a deal with the price and wired it myself when i moved in.
