fault on eicr

i inspected a property last thing on friday and had a fault that i know is wrong but am not sure how to express it in regs
old rewirable consumer unit in third floor flat, when i took the two lighting fuses out the lights remained on in the two bedrooms and bathrooms.
on further inspection i found a fused spur (with a 3 amp fuse luckily) supplying only the common side,
thus meaning that neutral from the lighting circuit and live from the ring via a spur.

any comments from the wise ones.

obviously i am recording it as a code 1
