Or C1 or C2 for new certificates...

A lighting circuit that uses 1.5mm singles in earthed trunking/conduit has a 15A BS 3036 fuse and a Zs of 1.05 ohms.

Following my understanding of 433.1.3 this fails as its rated current exceeds 0.725 times the current carrying capacity of the conductor (in this case, 15.5 Amps times 0.725 equals 11.24 Amps)
 
I'd give it C2.

Taken from the 'Guidance for Recipients' on the new IET forms...

7. For items classified in Section K as C1 (“Danger present”), the safety of those using the installation is at risk, and it is recommended that a competent person undertakes the necessary remedial work immediately.

8. For items classified in Section K as C2 (“Potentially dangerous”), the safety of those using the installation may be at risk and it is recommended that a competent person undertakes the necessary remedial work as a matter of urgency.
 
Code 2.

Try to imagine a code 1 as an immediate danger where no other event has to take place to make it dangerous (exposed live part etc.)

A code 2 would need a second event such as a fault/overload etc. to make it dangerous.
 
I would consider this to be either a code 2 or C2, as Archy says, it is potentially dangerous, rather than being immediatly dangerous.
The ESC BPGs have downgraded it from a code 1 to a code C2, not that it matters much, as either code would be considered as Unsatisfactory.
 
Thanks to all your swift replies, I thought it would be a code/C2 but as some consider an incorrect rating on an overcurrent device a code 1, I wasn't sure. I certainly consider it to be potentially dangerous, however, these codes are often open to interpretation.
 
There was some debate over whether a code 2 would be considered as Satisfactory or Unsatisfactory.
With the ESC/NICEIC being on the side of Unsatisfactory.
It may be, that the ESC advised a code 1 for such an instance, because they considered such a situation as being Unsatisfactory, and wanted to remove any doubt.
Now that both C1 and C2 are considered by all parties as being Unsatisfactory, they have moved that example to the code 2/C2 list where it should have been all the time.

I've spent a year doing a PIR, remedial work and some new installs on a large commercial premises, sorting out what I thought was a code 1 as I went along (the customer was reasonable with my fees).
I have always used the various code lists available as benchmarks, though few are the same and so I have often been confused.

I was struggling to finish this before the company broke up for christmas so I could use the old forms but didn't manage it. Looking at the new EICR though, I'm glad. The new coding system is, in my humble opinion, a great improvement over the old. From a business perspective too, it puts the onus on the customer to sort out C2s not just the C1s, so it could help generate more work (and not let landlords etc get away with shoddy installations).
