We in scotland have had the smoking ban longer than the full uk and it causes a lot of confusion who can be done (ie sole traders self employed ect )

couple of guys I worked with were sitting having a smoke in the van when Mr EHO knocked the window complete with his lapel mounted camera resulting in £50 fine for the passenger £50 fine for the driver
Driver also got a nice£200 fine as "he was in charge of the vehicle and as such had allowed the passenger to smoke"
they tried to argue that as they both smoked that it didnt matter as noone else was affected the responce was "its a commercial vehicle and the law relates to smoking in a commercial vehicle no matter what " so if your a sole trader /selfemployed smoker best step out the van have your smoke then stump out ciggy n put it in a can or asktray as if you throw it on the ground you can get a litter fine

Yes I have heard of that before makes me wonder how I stand it a commercial vehicle but is my own property and no one has access. Probably best to go to westminster and have a legal ciggie in the house of commons pub and discuss the merits as its the only pub exempt the smoking regulations.
