I just want to make sure nobody else has to put up with this organisation's dishonesty.

I signed up for a 3 month trial on "premium membership".

I am now being invoiced each quarter - and they are telling me that I should
have contacted them to cancel the trial - otherwise it automatically commits me to a full year.

I have tried to deal with this by phone twice.
The operators English is terrible (they are German) and they refused to put me through to a supervisor - as the supervisor doesn't speak English!
I asked who I should contact to appeal - they told me there is nobody to appeal to!

They cannot provide any evidence that the offer I signed up for stated clearly that the onus was on me to cancel. They say that I must have clicked on something in their website to agree to these terms.

Despite this they are threatening to place the matter in the hands of debt collectors.

Bear in mind that I have only ever replied to one potential job, didn't get it , and have never used the service since.

They have not listed my qualifications correctly on their website.
On the one job I did enquire about I was unable to contact the customer through their "system".

I am really feeling like holding out and not paying them - but don't want to risk a CCJ.

I sent a lengthy email explaining the situation to them - which they have ignored - simply sending me a "final demand".

Has anybody else held out and won???

Beware of these people.

I will post again to let you guys know the outcome of all this.

I am a start up company with pretty much nothing on the books at the moment.

The last thing I need is these parasites trying to bully me into paying for a service I have not used and which I clearly did not intend to commit to.

Dont fold under the pressure mate, that is what they are depending on, dont pay if you dont think you have had a fair service, contact trading standards and they should be able to help you, I had a simular experience, they ended up dropping the fees. ( not myhammer)

To get a CCJ they would need to take you to court, I wouldnt thought that they would do that, keep a note of all your telephone calls and letters sent.

is this outfit like some kind of agency? there are lots of agencies out there and they do not charge fees, other members are saying call their bluff, GO FOR IT!!! i feel it should work in your favour once the t/stands get involved
 
Print out the terms and conditions from the website attach a copy of these to letter of complaint to trading standards. If debt collectors do make contact take all the details of them and write a letter to them that the debt is in dispute.

You need to record all contact with them who you spoke to and the refusal to put you through to supervisors etc.

Write them a letter send it recorded delivery if you can and require all evidence they have of your contract with them and proof of what you agreed to and inform them that no further payments will be made until this is provided.

Keep copies of everything. If all else fails and it goes against you pay them a fiver a month towards you total bill. No court in the land will be interested if you are making some form of payment so no ccj.

Also pay C.A.B a visit for free advice on where you stand and what you can do

Maplin sell a useful little item that enables you to record telephone conversations....

Telephone PickUp Coil Music Maplin

Useful against the sort of companies who would never suspect you of recording conversations, and who are likely to incriminate themselves.

Also useful for dealing with certain customers ;)

JBL I had great fun when i told Orange that their call was being recorded for training and customer service they hung up lol

the legals mean you Have to tell them their being taped otherwise if you pull it out in court it will probably be thrown out

How about you add it in small print to your contact somewhere :confused: Then if you later begin having problems you would be covered to record.....maybe ;)
 
mate just file the invoice under B for BIN
ignore it and let them try and take you to court
how hard do you think it would be for a german comapany to take a uk citezen to court?
if it gets that far explain all this to the uk magistrate and he / she would throw it out within minuits and send them packing to deuchland

Yeah as above sod 'em. Just write a letter saying you've tried to sort it blah blah blah they've not given a good service and if they want paying for it you'll happily see them in small claims over it. They'll send some threatening letters that can also be filed under "bin", then they'll give up. I can't see them travelling from Germany for it can you! They'll try it on with everyone and 9/10 will pay up unfortunately. Don't be one of them
 
i really should have read this post carefully.

just signed myhammer, when tried to bid for a job, then they charge 6%vat(about 10 pounds) for sending my contact details, charge more than 10% of total if winning the bid, god, this is really blood sucker, they should explain this payment arrangement before signing the contract, will send them an email to cancel this asap,
