The NICEIC EICR form has, on 7.7 of the schedule of inspections the following tick box:

'Recessed luminaires...installed to minimise build-up of heat by use of 'fire-rated' fittings, insulation displacement box or similar'

The bit i dont get is the mention of fire rated fittings. Common misconception isnt it that fire rated means they wont catch fire if you bury them in insulation(!!) - doesnt it just mean that the fire rating means they hinder the spread of fires upwards from room to room. I believe this tickbox is inaccurate and misleading. Am I on to something here?!?!

So i'm doing an eicr and it's top floor flat with no habitable rooms upstairs. Not fire rated downlights. This is fine and was not going to record a fault. but do niceic expect me to find a fault on this tickbox?! Why?

I believe NICEIC have added this section to their own forms & its not in the model forms.
I suspect they mean the fire hood or inbuilt material in fire rated fitting will activate before a fire starts in ceiling.
I wouldn't worry about the wording but would worry about cheap open fittings with no protection.
 
The certificate is following BS7671, Fire Rated fitting can also comes under building regs; what i assume the cert covers is fitting that are required to be fire rated according to the BS7671 and not where they don't maintain the rating of say a plasterboard under building regs but do comply to the 7671.

If the 7671 states the fitting require to be fire rated in their set-up then X the appropriate box.
 
Even if they are on top floor?!
Depends what crap is above ceiling & if therefore fire risk. Could apply to a bungalow.
ESC guide suggests C2 for incorrectly "installed" or "selected" downlights.
Of course it's up to inspector on site to assess the risk.
