A colleague of mine has been working for a certain client and it has come to light that for whatever reason he did not issue a certificate or register the job as we all know we should.

Another sparks has gone to the same house and an earth reading was slightly high and he asked to see the certificate from the last works carried out.

The work my colleague carried out was in 2005, so at least 4 years ago.

Now, nobody is saying that as no certificate was issued and no registration was done is correct.
But, my question is, what comeback could there be after 4 years?

For what it is worth, he has certificates etc for all other jobs for all other works done, this is an admin error.
 
Hmmm tricky.

Although everything could be in top order, he could still get done for "failure to notify" if the LABC could be bothered.

I know in some areas they are.
 
Dont worry about it no-one been injured or killed no-ones gonna pay legal cost to bring you (oops your friend i mean) to justice, up untill the last 10yrs certs rarely got issued unless requested
 
Doubt if anyone will give a monkeys really...the LABC have got enough on their plate as it is, and with the general election looming, the majority of the LABC guys will be worrying about cost cutting and jobs etc.

A mate of mine went to a disaster of a job last year, because no one had been injured the LABC weren't interested,
H&S weren't interested for the same reason & neither were trading standards!

Are you referring to failure to notify?
If so then I think the ability to bring to court has long since expired.
I read somewhere that the offence of not notifying to LABC is same level of crime as speeding offences etc. so must be brought to magistrates within 6 months.

Cant remember where I read it so if someone can provide a link that would help, as I dont like speading rumours :D

Anyway, yes he did fail to notify and also fail to produce a certificate.

Interestingly, the sparks that is now picking up the works at the house has condemned the fact that he has not put a fire hood over the low voltage transformers in the ceiling void.

Is that a requirement then?
I thought fire hoods were a requirement when the room above was a different fire zone.
With the exception of an attached garage a house is usually 1 zone isnt it?

Also I thought fire hoods were for the luminares not the transformers as the purpose of the hood is maintain the fire break of the ceiling to prevent a fire in the room spreading upwards through the building. We have a similar issue with in ceiling speakers but fit hoods to maintain fire seal of the hole, or 1Hr rated encolsed units.
 
Its not something I have ever heard of and the chap maybe trying to scaremonger but, if they required hoods then why would be be installing fireproof lights these days, it just doesnt make sense

Good practice would mean making sure there is room for heat loss

The fire rated integrity that needs supporting is the hole that has been cut and the method of reinstating that integrity
 
My colleague has been in touch with napit and as he hsa offered to go back to certify etc etc and they wont let him in the house, they reckon the client has no grounds to take it any further
