last month, january i worked 193 hours. when it came to being paid i was only paid 135 hours. i keep a diary of all my hours including dates, times, job numbers and client/site names.
i spoke to my employer and gave him a photo-copy of my diary as proof of the hours i worked.
he said he'd look into it. i write out my diary from the job sheets as then i know my hours are recorded in my diary and on job sheets.

i phoned up today to see if it was sorted. he replied erm no all the hours on the job sheets you've been paid for. i know i've writtenall the job sheets out alongside my diary.

i'm now facing losing 58 hours pay through no fault of my own.
as a 2nd year apprentice i can't afford to loose ÂŁ375.

could somebody please help me as to where i stand and what i can do?

many thanks
lawrence.

As above but if the answer is no contact the citizens advice people and they will point you in the right direction.

However remember even if you go for another job and get it where is your job reference coming from

Do you want to continue working for him?

the thing is if i leave the company (quite a large one) then the chances of me getting another apprenticeship are basically zero. all i have left to do is my NVQ. its a massive catch 22 leave and have to give up 2 years work and have a crappy job or stay till im qualified then get outta there.

I feel for you mate, I think prehaps the best approach might be to arrange to see him in the office, take all the time sheets ( record of hours ) all the relevant pay slips and ask him to prove your wrong - But be very nice about it.
Make sure the claims you make are bullit proof take any other supporting paper work you may have - petrol recipts you obtained on that day close to that particular job etc plead your case and make him feel sorry for I know it's a bit belittling but you got to do what it takes. best of luck

58 hours is that from 1 week? Has he missplaced/lost a job/timesheet. How about asking for photocopies of the weeks in dispute. ~ it may be an honest mistake.

In future i would advise taking photocopies, before submitting.

that's over a month. in future i shall be photocopying all job sheets.

i've told them about it, shown them my diary and all they've said is, we cant find the job sheets. they know ive worked 4 full weeks so that's 160 hours, they also know ive worked overtime at night and weekends.

i just dont see how they can just say unlucky and not pay me. they've done it to other lads this month as well. one lad lost 95 hours. another lost 41 and another lost 20. none of us had worked together this last month either. i'm starting to think this may not have been much of an accident.

He sounds like a right toad your gaffer!!!!!! As the guys have said you need to be able to show him your hours worked....do the vans have trackers or anything like that????

we do have trackers but the problem is we have a factory where we build our own products. i've been in there for 2.5 weeks this month which means i cant use the trackers as back up. i have said to them to check the sign in/out book, they replied we know you were here but we dont have our own copies of what youve been doing. despite the fact i've given them my diary with all job numbers and what i've been doing. i cant see why theyre not paying me because theyve fooked up. i've been at college this week but will go into the offices on saturday just like i did last saturday when i first realised. i'll be very calm and polite while stating that i want my wages.

Dont worry about the reference if you go for another job, it is Illegal to give a bad one. If they do provide references they have to answer any questions honestly, cant give you a bad one, but they can refuse to give one at all. You have a legal right to see anything they do write about you under the data protection act.

Regarding your money, are you in a union, if you are give them a call, if you aren't then join one because you will get endless legal advice for free.

Cheers.........Howard

how'd you get on?

i went in and kept my cool. one lad left yesterday over his hours being short leaving us short staffed, which i think is a good thing. i said i want all the job sheets and gave them the job numbers, i went through and high-lighted all my hours and added they up. they came to exactly what i said they were. i gave them to my manager and said there you go all my hours. he apologised for being a bellend and said my wages would be added onto next months, plus an extra 10 hours pay by way of apology and intrest. the office who takes all the hours off the job sheets has also been given a disciplinary (written warning) for not doing her job correctly and causing un needed stress and loss of money.

r.e. joining a union, i'm doing that now :)

thanks for all your help.

lawrence
