A client ceases to be a client the minute you finish the current project.

You can not stop a sub-contractor for working at any time, even for a past client, its restrictive practice and has been tested in the courts, many companies tried this some years back with clause's in employment contracts stating that an employee could not carry out any work of a similar nature once they left their employ, this was again tested in court and found not to be binding.

You obviously made money on the back of this work without giving them any of the benefits of being an employee, take it on the chin and move on.

Harsh but so true.... ! But in many fields it can be legal to stop ex staff from even calling clients let alone working for them. Its for a fixed period I think"Garden leave" ???????
 
Garden leave only applies during a notice period when a company ask you to work from home for the duration of your notice, think of those that leave a company and take clients with them, once your notice period is completed your ex company can not dictate what you do.

In simple terms think of a bricklayer who has been sacked and told he can't lay any bricks for six months after his termination, does not work like that.
 
Works both ways, I had a six month notice period from one of the companies I worked for many years ago, when they made me redundant they where astounded when I said "OK the company car will be available to you in six months time" company cars are part of your salary package and apply during your notice period, including the dental and health plan.

We have a chap who works for us a lot and who is self employed. We have found out that he may have done some work recently for one of our clients who we have not done anything for in about 6 years or so. Just wondered what your view is on him doing work for a client of ours, albeit 6 years ago, but still working for us. By the way. he knows that the person was a client of ours as he has done work with us for the client.
