silly question i know but if i were to change a CU over to a split load RCD protected CU but keep the old wiring (old colours) would it be able to be tested and passed?

No, there is no pass or fail and the cable colours are irrelevant. If the CU is replaced then all the circuits must be tested and inspected. The installation should be brought up to the current standards, and certified as compliant to those standards on the EIC including any limitations noted which may apply to it. There is no pass or fail. It is either compliant or it isn't, if its compliant then the installer has to issue the relevant paperwork, this is a legal requirement of Building Regulations.

don`t forget the sticker "caution this installation has wiring colours to two versions of BS7671"

See, now I was going to mention that. But then thought not to, but of course the neutral tails on the RCD's are going to be blue now...

So yes, stick your labels on! :)
