From the message on the thermostat it is quite clearly an optional thing that people have a choice over.

And I don't see how they've made any actual link to smart meters there?
 
Xcel confirmed to local news station Denver7 that “22,000 customers who had signed up for the Colorado AC Rewards program were locked out of their smart thermostats for hours on Tuesday.

And they sold themselves to the devil for;

The poco across the pond has installed smart meters all over everywhere. I’m glad because my power bill was out rages but has now dropped over $ 120.00 a month. Over here now you have to set up work orders to do anything. They put out 139 pages of electrical installation and I know one person ( not) me that work was approved by the inspector but the power company refused to energize it.
