Maybe a little bit of engineering judgement could be appied here.

first of, what are they supplying? perhaps they are both supplying a low load and fused at say 3 or 5 amps.

The big red book is there for guidance but we are not sheep and should be able to take an assessment on the particular problem at hand and decide if a danger exists.
 
The periodic should ask the question Is it safe for continued use?

You find a long term (maybe) ongoing non compliance,the spur to spur
It is not an immediate danger.you are not going to get killed using it or touching it deliberately or accidentally

It does not comply with regs code 4
It requires improvement code 2
It is not an immediate danger no code 1

Code 2 IEE ,real economic world and thinking mans guidance = satisfactory depending on rest of installation and this item requires improvement
Code 2 Esc and Niceic (they are effectively one and the same ) = whole of installation is unsatisfactory
Either improve the deviation or give it an unsatisfactory

You pay your money and takes your choice

Personally I would never code 1 this deviation
If I gave it a code 2 on an otherwise ok installation it would read overall satisfactory
 
The original problem of spur off a spur is code 2. No question. If it was protected by an fcu at the point of connection into the ring then no problem. You could even wire it in 1.5 and have loads of them if you so wish! However I did make a comment that a socket without an earth is also a code 2. After a quick bit of checking I found out that this is also true. As are non enclosed connectors in a ceiling, no earth on a lighting circuit with metal fittings and fixtures, no main protrctive bonding et al. All code 2
Code 1 is only to be issued where there is immediate danger or no earthing anywhere at all on the wiring system.Hope this unbelievable bit of info helps. Or at least creates a mild form of astonishment! Cheers!
