So I was working for a bloke, one man band. Pay is outstanding, no payslips for what I did get. How have any of you gone about getting paid, not involving Mr Hammer!

Tried phoning, email so far. Was paid the 1st month, 2nd was a week short, now waiting on a couple Weeks of the next plus the week outstanding, not received any timesheet. Was working off cis,, and have copies of the timesheets. Small claims threat/summons was my first guess

Before you commence court proceedings you need to firstly demonstrate you have given the bod opportunites to pay so 2nd copies of invoices, plus politely worded letters, THEN your final demand which needs to include the following sentence:

"I attach my original invoice to this letter and wish to inform you, that if the invoice is not settled in full by xx --- 201x, I intend to refer this matter to the Small Claims Court without further reference to you."

Bottom line is that if you don't allow the chap time to pay, your claim will not be upheld and a further word of warning, even if you do get a "win" in the court there is still no guarantee that you'll get paid, especially if having a CCJ against the individual isn't a concern.

The whole system stinks.
