Hi,

A the title says, I have the opportunity to subcontract back to my previous employer, I have been given forms by them to sign but was wondering whether or not you subbies on here have any T&C's templates that you use and would submit for any potential subcontracting jobs.
Things like cancellation notice etc.....
Thanks in advance.

Best be careful, IR35!
He is taking you on as a subby to avoid employers NI. (13% on top of your earnings)?
Currently a clampdown on this by HMRC and next week I am starting books in with a company as I cannot use my CIS UTR anymore after 3 years freelance (or bogus self employed as it has become known).
You need to be able to prove you are genuinely self employed. Maybe by also supplying materials or if you employ another.

Thanks for the advice.

I have my own Ltd company, and have my own works, my previous company specialised in UPS installs so want to take me on as a subcontractor from time to time as I have 10 years experience in that field, so he is not taking me back on for other than genuine reasons! And it will be only every now and again rather than prolonged periods.

I don't think HMRC will be too bothered about IR35 if less than 70% of your turn over comes from the same company. They are after the 95-100% values!
