last night I discovered that an mcs/real registered company (February) called solarsavings4u ltd from the next town has placed an ad in our local paper using the name solarsavings.

I can't believe that benchmark (taking over my registration from corgi in a couple of months) or real can/would register another company that is based only 6 miles away using a very similar name to ours.

I'm going to have get in touch with a solicitor this morning as this is going to get very messy.

Sounds like you're have a nightmare with your company name. It's not really on and I'd suggest you've got a really strong case.

What a day I now have a trademarks solicitor from Shoosmiths on the case so by Friday the other company will see the error of their ways. I'm having to rely on whats known as "passing off" to prevent them using the name solarsavings anywhere in their title. Given that I have my name and trading name going back to 2005 easily found on the internet it should be enough to protect it( well they would say that wouldn't they).

Lesson learned: do what two forum members have done and trademark your trading name asap just because you have a registered company does not protect the name.

sounds like a clear case of passing off to me. Shot across the bows with a cease and desist notice or similar should do the trick. Worth having a word with REAL and MCS about it as wel, as they may well force them to change the name they're registered with.
