the immersion is a bs 3456, I presume this is pre dates bs 60335/2/73 and the bs 3456 has no cutout. is this correct.

Immersionon heater does not comply with
BS EN 60335-2-73 (that is, it does not have a
built in cut-out that will operate if the stored
water temperature reaches 98 °C if the
thermostat fails), and the cold water storage
tank is plastic

Taken from the ECS guide for Periodic Inspection & Testing

So if all above then a code 2 would be in order
 
i would make a note in the comments section of your PIR, advising of this. is it an element where you can replace the stat. with a modern one?
 
will make a note, I have not taken it off yet so do not know if I can just replace stat. I would think to replce whole lot as the system seems to be at least 20 to 30 years old.
