Can u be taken to court for EICR 13 months after it was issued

Again. 50 fake adverts on facebook etc offering "cheap" EICR's . Cash or card machine payment into a dodgy account etc . Smash out hundreds . Customer has no idea . change sims etc .Whats the chances of ever getting caught .Its not the whole thing is been policed anyway !

That's irrelevant - you can't have a 'fake' report, because there's no statute 'right' one. All you have is a decision based on competencies and due diligence.

It doesn't matter how poor a report is from our own professional perspectives, or even who produced it, the law requires it to be fit for purpose, and EAWR89 Reg 29 states ".... it shall be a defence for any person to prove that he took all reasonable steps and exercised all due diligence to avoid the commission of that offence." So if you can't show that you did the job properly, within your experience and training, good luck to you.

I teach my 10yr old daughter something that my (ex Copper) Dad also drummed into me as a kid - "If you can't do the time, don't do the crime!!"

I've just had a look on eBay, if you search for EICR, once you get past the cheaper listings for certificates, NAPIT codebreakers and other out of date books, there are a few for £100 for an actual EICR. Interesting.

To answer the original question, yes you can be taken to court for anything if someone wishes to pursue a claim, but the time period between the occurrence and the claim is of critical importance, anything could have transpired between the two events, you would be allowed access to the item in question to establish if alterations had been carried out and compromised the installation after your works where complete, the claimant in this case does not stand a chance of making any claim valid, it is their word against yours, just don't admit to anything and consistently uphold your stance that the works had been compromised after your inspection.

I agree. Not saying it’s you the OP who is the person who is in doubt in this situation but my advice is don’t be worried or intimidated by this new spark who’s quoted the repairs at £7500. He’s just a guy who is trying to make himself sound good and put others down. It’s easy to find faults in other peoples work but not your own. As long as you did the EICR properly and when I say properly I mean you didn’t lie or cheat the report. You are entitled to do what you deem reasonable and acceptable in the EICR. I’m the type which is over cautious and get criticised for coding things which others would not but that’s not because I’m trying to generate more work I’m just saying on my report I would consider upgrading/updating certain aspects of the electrical installation.
