Four weeks later and his website still shows 'NICEIC Approved Contractor'. Perhaps the misuse of logo dept have been on an extended holiday. Either that or they really do not have any teeth.

I contacted NIC again and told them am not impressed with their efforts thus far. This is the reply I got back:

Apologise for the delay in acknowledging your enquiry, regarding the misrepresentation by ######### Testing Limited.
I can confirm that ########## Testing Limited are not registered as either an Approved Contractor or a Domestic Installer with this organisation, we will now be investigating the matter further with the contractor internally. When you first reported this misrepresentation back in August 2010, the logo had been removed, but it now appears the contractor has added the logo back on their website.
The Wall of Shame has only been in action since 1 November 2010. Once a misuse has been notified we write to the trader, giving them 14 days to remove the misuse. In the majority of cases the trader has amended the misuse within the given time and so no further action is taken. However, should the trader continue to misuse we add their details to the Wall of Shame and refer them to Trading Standards to investigate wall.
The NICEIC takes the misrepresentation of its logos very seriously and would like to thank you for the information you have provided.

If you have already contacted or are going to contact trading standards I dont see what action the Nic is proposing that differs from any individual who could do exactly the same
It seems to me to be a poor response by the nic to one of their members, and if it were me I would be asking what actions they will take, other than just reporting the incident and inclusion on the wall of fame. or shame or whatever the wall is called

I am not a member of NIC. Will (reluctantly) be looking to join a competent persons scheme this year so I can legally do domestic work in special locations. Judging by their actions thus far on this matter, I feel inclined to join one of the other schemes who may use my money in a better way to look after my interests.
The NICEIC approved contractor scheme covers fixed wiring, not portable appliances.
Unless the person is offering to work on fixed wiring, then no fraud is being commited.
Ah me presuming things instead of reading more closely ,good luck with your registering anyway whoever is chosen
I am not in the nic,but if you need to generate work,they are still, by far, the best option
It still doesn't alter the situation that you are in competition with someone who is falsly trying to gain unfair advantage by lying about approval
The nic response seems neither strong enough or speedy enough

Surely there is still a charge of misrepresenting himself so as to gain unfair advantage over other competition and this would contravene trading standards rules ?
