Westwood10 thank you mate I've took down the ccu and can see a metal conduit has been run as the earth took a zdb reading off it and got 0.13 happy days now I no why they took it off the neutral because they couldn't get a 16mm earth off the conduit
you mean because they were too idle or too incompetent to use the conduit as cpc?
 
Incompetent I agree untill I took the board off I couldn't confirm if an earth existed I've taken it off as u can see above told the cilent that if no earth exist I have to run one in by the time I gave them an update I got am email saying how they got a second opinion by another contactor who said I was lieing and that you can tap in to the neutral to get an earth and that they don't want me to carry on and the other contractor will sign it off as safe

Perhaps you should quote them the regulation which strictly prohibits a PEN conductor on the consumers side of an installation and explain the implications of leaving it that way.
Or maybe the client is lying and doesn't want to pay...
 
I agree using a pen conducted like this is a big no no unfortunately sometimes I think clients think your trying to rip them off by finding problems but isn't that what the point of an eicr is , and if there's no problems all the better.
Too many of those bloody rouge traders programmes on TV I think to blame tars us all with the same brush .
 
Ive explained it to the customer via email awaiting reply they worried all flats which have had ccu replaced in the last 5 years are they same and that I'm trying to generate work out of them. We see what tomarrow brings have to say thank you one more time guys thank you for all your inputs
 
It's incredulous that they wouldn't believe you, you being the professional 'they' asked to perform the EICR. Good will come from this for you, a good bit of tidy up work. I can imagine that they are trying to get their heads around the fact that 'another professional' has left them in this position.

This is where your scheme registration come in handy.
Send in the photo and ask them for their opinion, also ask them about the dangers of PEN conductors- email them and get a reply.
Then send the email together with a dangerous installation cert so your back is covered.
