Neighbors from hell(mand)

Hi, probably wrong place, but, I am completely miffed with my neighbors, They are convert property next to mine to a fast food establishment, they have put in for planning permission, to build a small store room to back of building, and run some ducting, along an existing wall, with a flue about 2m above existing wall height at the end of the property, But what they have actually done, is dragged two shipping containers upto building, welded them together, fitted a nice door on the side, and whacked all ventalation,motors and silencers, about half way along top, and about twice as high as what was agreed by the LBA, and about the half the length,

Its quite hard to describe, so I have attempted to upload a modify version of the actual planning application, up top, is what was agreed, below, is my effort of replicating the actual installation.

I think owners are Pakistani, and the "contractors" seem Turkish or Romany, motor supply seems to be in grey flat 3core and earth, clipped direct on top of shipping container in direct sunlight, and managed to completely miss the blind grommet in the terminal housing, and is sited through an unprotected knockout with no additional protection or support, all i can see of the electrical installation.

We have about 2m high fence, and the "installation" is about a meter and half away from it, we have lost a large portion of our horizon to this metallic nessie-like contraption, and are quite likely be subjected to the noise of the fans once they open up the shop, the fans were meant to be inside the new extension they didnt build.

What can I do about it? seems ludicrous they will put all the money and effort into building this.

Make sure they don't steal any post you get from the council. Happened to my girlfriend when the take away below her flat were applying to stay open til 4am. Altho they did have a key to her flat to get to their extractor fans which were in her kitchen!!
 
First strong wind and that chimney/ducting looks like it's going to be down - it is already well off vertical.
I agree, the installation doesn't look safe.

Not sure about the UK regs but if that is kitchen extraction ducting then it should be welded steel where I am, mez-flange ducting which is what's in the photo is for airconditioning only, it doesn't meet the fire codes for grease extract. The electrical installation looks like a joke as well. Finally with kitchen extract you're supposed to discharge vertically at a good velocity, horizontal discharge will coat the surrounding area in a layer of grease over time. Also it will get on peoples vehicles and neighbours washing that's hung out to dry.

I would kick up a sh1tstorm with the environmental guys, health and safety, the building inspectors, the electrical authority and anyone else you can think of.
 
I think Marvo is onto something with that, I think I will call the manufacturer tomorrow and check with them, looking at the specs from the planning application fan is from "eltafans" and is labeled as a "slcs630" a quote from the gumph is
"Applications
Shopping malls, stairwell pressurization, enclosed car
parks, residential and public buildings, underground
stations and theatres."

No mention of commercial kitchens, is labelled "smokevent" so looked legit, but seems that is to with its fire rating, can work for upto 2 hours in event of fire, thats of course if the grey flat 3core and earth gaffer taped to the ducting does not melt first !
 
If you allow that monstrosity to remain as your neighbour then you would have more tolerance than me
I would go through the correct channels as the good people have advised and, failing that, get the Gypos in

If the Gypos diidnt want the job I would do myself a favour and have one night with a little shortage of sleep

When I awoke the following day the eyesore/problem will have ceased

Phone, phone, email and phone again. LBC, councillors, MP, newspaper anyone who can have an influence - make them want to get it sorted so that you will stop pestering them. Think Andy Dufresne's library requests in the Sureshank redemption. :)


My favourite film fella. The issue: well that is all what you can do and be - persistent and going down the right channels. You can take the media route too and might find a sympathetic ear from a local journalist. The key here I think is that you are going to want that thing down more than they want it up. "It's illegal so it should come down" attitude I doubt will do it. Need to get the powers above to act on what's not right.
