Like everything I expect there's a way around this; some law was introduced where agency staff had to be paid the same as those on the cards. The last company I worked for started workers off on a lower rate for a couple of weeks so they only had to pay the agency staff that rate.

I don't really understand why they've introduced this rule - I thought the idea was supposed to be to encourage more people to work.

That would be illegal on challenge as the employee has to be "comparable" to the agency worker. So after x weeks then they would have to get the increased rate also (after the 12-week qualifying period).

What happens on many sites is agency workers approach twelve weeks working there,they pump them and get new ones in,or they just ignore the law.
 
Think you will find that some of these walkouts have in fact been successful.
Since the changes, lads who were once considered self employed are now deemed to not be so.
They are now being subjected to employees national Insurance Contributions and also Employers contributions....This amounts to them now being taxed via the national Insurance and being relieved of about £100 per week......Some will look on this and say well....they should pay national insurance, we do...Looking at the facts though they are now paying 2 lots....The employees, as you do, also for some reason the Employers, which is even more than the employees.....Strange one as they are obviously an employee as they are no longer deemed to be self employed and are now working for an agency via a payroll company.
 
The walkouts have been a success with getting jobs on the books - where they should have been in the first place.

I am in two minds about the new tax laws that have came in as it appears to me that not much has changed.
The agencies are still there and the payment companies as well.

The only thing that has changed is the CIS Scheme rules are being enforced and this is forcing sparks to either go LTD company or umbrella.

If you go umbrella you are pumped for tax and it will get worse next summer when they will start taking employer's and employee's pension payment out of the wage.
Sparks are being forced to commit tax fraud to make up their wages by claiming for every possible expense going.
Some umbrella companies take money from you each week for holiday pay as well and have the cheek to charge you for getting it.
 
The main problem is the bogus self employment is still there.
The client - the employer's in the eyes of the law are dodging the cost and laws emloying men with the use of agencies.

The standard fee for an agency to charge a company is £2 an hour more than they pay a spark and that is the problem.
It is cheaper and easier for companies to use an agency than have sparks books in - AND THIS IS WHAT NEEDS TO CHANGE.

I feel that there has to be another two or three changes to the law before this shambolic system is sorted and meanwhile ordinary workers are paying the price.
 
One of the sparks mates on my job got his payslip today under the new umbrella company.He is on £100 a day 5 days a week.Under the CIS he took home £380 a week,this week he took home £318.That is a £3000 a year pay cut for doing exactly the same job and the vermin payment company are still charging him for the privilege

Same sort of thing on the job I'm on the agency sparks are 100 quid a week down so taking home around somewhere between 380-400 quid a week, none of them are happy but they don't seem to be doing out about it
 
The thing with umbrella companies is that you have to simply have an expense claim for hundreds of pounds a week or you are complety shafted for tax.
But it is on your own head if the tax man comes after you.
 
Even if you falsify your expenses to bring yourself up to nearly what you were earning before you still wont have a tax rebate at the end of the year so you are still a couple of grand down
 
Yeah either way your loosing that 25% off your wages and if you hammer the expenses when on the umbrella your just putting a target on your back to get shafted by hmrc so your getting shafted from all sides AGAIN

all the the agency lads need to stand up and tell them where to stick it, all it's doing is dropping rates from £14-16 an hour down to £10.50-12 an hour on the sly
 
I have always worked umbrella/composite company whenever I have worked for an agency as I don't see why I should have to do a tax return on a yearly basis just to earn a living,but each to there own.
If I was mainly doing agency work it would have to be LTD company.

The thing with LTD companies is that many set one up at the end of the tax tear there so HMRC can clearly see who set one up,and how many set one up to get round the new tax rules.
Many MP's and other rich people work through LTD companies to lessen the amount off tax they pay and the LTD companies might now be the next target - as they will be after a new target in another few years.

I was speaking to a member of UCATT last week and he said that they had a promise of Ed Balls that if Labour get in they will do somethiing about bogus self employment - but we can't forget that they did nothing about this in their 13 years in power the last time.
