I did some work in November '08 for someone. It was only for a couple of weeks, and he told me I'd have my money when he got his. Fair enough I thought, being a naive young lad.

I'm still waiting for that money. Stop working for him immediately, he's taking the part P, and you'll end up suffering if you carry this on much longer.
 
If your stuggling for work then its best not to jump the gun, your first course of action is to arange a meeting and go sit down with him with your invoices and ask whats happening about your money and if there is any problems that his having, keep it civil and polite and that if he wants you to do any more work then you want proper terms of payment sorted. Show him how long you have been waiting and that you do enjoy working for him but at the end of the day you need money to pay bills/live. At lease then you can say that you have tried to be civil about things and that he still refuses to pay
 
Look mate subying can be great but you need to stop working for him now don't go tomorrow......I'm afraid some people will just not pay which is wrong but trying to force them through legal means is a nightmare.
 
I wouldn’t choose the solution of not showing to work anymore. The best thing would have been to have a clear contract which clearly stipulates all terms. But if this isn’t true , not showing will probably make you lose all the money. If he paid you before maybe there is a chance to discuss the things in a polite manner and clearly establish a rule from now on, how it should be and how he should give you the remaining money, and after that you can have a clear statement of how things should be. If he would agree to sign some kind of payment plan would be great.
 
I know its tempting to carry on because you probably need the money but what happens if his customer fails to pay him. This has happened to me I would say stop working for him until he pays up explain it to him im sure he will understand your point of view would he carry on with a job if the customer failed to pay the first instalment

contract law states that it is illegal for him not to pay you until he is paid. he must pay you according to the terms of your contract with him, problem is you done have a contract with him. although if you agreed payment terms verbally with him before you started that is your contract. so what you need to do is:

1) write on a piece of paper (ideally in your diary/ day book on the appropriate date) with the date and time of the conversation you had before you started where you agreed on the price/ rate and payment terms as well as the names of the people who were there (him and you at the very least).
2) go to site and tell him that you will not work any more until he has paid up to date as per your original agreement.
3) leave on good terms and go home with your stuff (so he cant lock you off site and deny you access to your stuff). make sure before you go you agree on how and when you will get paid. make notes of this and both of you sign a copy of the notes.
4) if he misses the first payment as you agreed call him or better still go and see him immediately to find out why he did not pay, record the conversation.
5) if nothing happens tell him you are proceeding as per above letters or worse as per a previous thread you will start bankrupcy precedures against him.

for the first conversation do it in orivate so he does not get embarassed infront of staff or subbies. if it gets to point 4 embarassement will make him a bit more keen especially if others overhear the conversation that he obviously cannot pay any more so you will start bankrupcy proceedings, really useful if his client is in the room as well and hears this.

I think it is of great importance what kind of a guy is the boss – you probably got to know him, you have an idea if he is a correct person with some financial problems or he is an absolute jerk. Maybe you should decide accordingly.

Not to sure but a verbal agreement can be classed as a contract.
 
you are right, in the UK a verbal agreement is a contract. write down what you believe was said and the date plus who was there and you have the record that you can start your discussion with the 'client' with.
