Your carrying out an eicr on a domestic property with a time delay 100mA RCD protecting lighting cables within 50 mm of the surface.
What code would you give it c3 or c2?
 
Cables buried less than 50mm from surface require protection by mechanical protection such as earthed metallic conduit ,swa etc or be installed with additional protection by an rcd.
Only a 30ma rcd offers additional protection in this manner.
The OP needs to decide if indeed it's a C2 which is potentially dangerous or C3 requires improvement to make it safer.
 
RCD protection for cables in walls came in with 17th IIRC (?) so if it was built prior and it's in good condition etc then isn't it a C3 at most?
