If the Yellow button is sutch a problem. Super glue it in the "pressed" position and put a drop of black paint on it.

On what grounds would you fail an assessment?

I'm not saying you would fail the assessment, in fact from what I can make out very few people do, but is it worth the risk for the sake of keeping an obsolete method of ADS?
Surely the object of the exercise is to pass the assessment, not open a whole can of worms when the assessor asks why you've left a VOELCB as a main switch?
You might be able to come up with a very convincing argument as to why you should install to a previous edition of the regs using BS3036 fuses and no RCD protection, but the assessor might not like it, and in this instance the object of the exercise is to pass an assessment, not argue that standards have slipped and things were better in your day.

Adam, you might have missed the point.
The thing is being disabled as a means of ADS, it's being left as a point of isolation only.
I think we established that.
What I'm saying is a VOELCB used to be used as a means of ADS.
A VOELCB with the earth taken out is still a VOELCB.
 
A disfunctional VOELCB. Identify it as such and it becomes a good quality, perfectly functional isolator.

I haven’t taken it out of its box, that makes it old, I don’t understand it therefore replace it!

No it isn't.
If you remove its means of functionality it ceases to be a protective device and becomes a manually operated switch!

Ah now I get it - so to the untrained eye it looks like a protective device but it's actually just a switch, like those tins of nuts which when you open them three spring-loaded 'snakes' spring out and give you the shock of your life?
Or a joke fire extinguisher
Or a wall painted to look like it's got an emergency exit on it
