It does (now), but before the Reg was changed there was no exemption for running the cpc not collectively surrounded by the same ferromagnetic material as the live conductors, i.e. the phase(s) and neutral.

I thought you could always run an external cpc to help reduce the resistance of the fault path, as long as they are terminated at the same point ie at the bolt of the banjo

Not according to the Regs.
People have done it for ages, which is why they have now allowed it.
