This thread titled "Live garden SWA wrapped in tape" is posted in the under the DIY Electrical Advice on Electricians Forums.

The image shows an SWA feed for a garden building which is not yet built. The feed is part of a new build house installation and the circuit is supplied via a hager RCBO and was energised when I found the cable, I've switched the breaker off. Is leaving a circuit in this condition compliant with the 18th Edition?

It's not compliant with the electricity at work Act 1989.the one that lands you in court /jail if something happens.the regs are guidance
 
My son bought a new build about two years ago. One switch of a 3G in the kitchen did nothing. Coil of 1.0mm2 T&E with exposed ends found on the top of a kitchen unit. Live when the mystery switch was on.
That was an extra cable for under unit lights lol .in truth some of the best sparkies I have ever worked with have made a mistake ,after all we are all human and for what ever reason sparkys undergo the same duress /stress as everyone else be it being put under impossible pressure by management or personal issues but what the op has posted seems an act of incompetence. But maybe his mate said he had placed it in a jb ,still wouldn't energize it though .
 
IMO the cable on top of the kitchen unit is more dangerous than the OP's. At least that one is taped up and in view, and would be approached with caution, as it seems the OP has. The kitchen unit one was not taped and just waiting for someone to reach onto the top of the unit.
It was RCD protected, I suppose, while the OP's may not be. No excuse for either.

How do you know it was energised? Just because the RCBO maybe ON, It may not have been as the cable may not have been connected within the CU. (See #2)
