It shouldn't really matter which terminal is used.
According to the diagram, you should put the permanent line in L1 and the switched line in L2.
There are a number of options for determining which is permanent and which is switched.
I would use a volt stick.
Sorry just realised, should be L and L1 not L1 and L2.

yeah ok it might not be the best looking PIR switch but.
The switch needs to fit a single gang box to replace the switch so I can't use the other you suggested.
so the black cable with the small red scripe should go where?

With the connections on your wiring diagram. Put the red (permanent live) into L and put the black with red cable marker (switch live) into L1.

Thank You so much this explains all I need to know to connect the PIR switch. All these old houses have different wiring.
When it comes to old wiring I don't know which wire is which lol.

Thanks again all of you for your help & support on my next pay day (8th July) I'll buy the switch & install it on the day it arrives :-D.

Out of curiosity, what type of lights do you have in your kitchen?

I have got a single florecsent light with a single gang switch.

I have brought the switch for less then £10 just to try it out.
When it arrives & that noone is home I can switch off all the downstairs lights.

I'm hoping that everyone will love it & it will save us on electric bills.
