Had a call out from an estate agents I do work for, seen this and recommended to the agent it was addressed, and possibly an Eicr carried out as who knows what the rest of the property could be like! I don't know what its feeding as was late at night and only there to address a faulty cooker hood!

The size of the conductor in relation to the back up fuse - the cable could be so overloaded that it would be a definite fire risk while the so-called 'OCPD' wouldn't even be warming up. Slightly different of course if there is further appropriate protection before any load on the circuit.
 
No code if there is a fuse before any fixed wire equipment is installed.

What difference is there between this situation and a busbar chamber?
There needs to be one point of isolation for the whole installation does there not?. Could be coded for that, of course if there is no upstream device.

Isolation being disconnection of all live conductors, before main fuse is mentioned.

Difference is generally bus bar chamber has switched fuses within 3m.
 
This is true, and it wasn't an eicr that was carried out so coding wasn't required! If it was coded for further investigation then it still would be unsatisfactory! The cable still has the potential to be used for something else, and with a diy expert potentially on the loose this could easily happen, so a C2 for potential danger if a foreseeable event was to occur.......

Does that stop someone changing whatever is being fed in the future? The cable still isn't protected!

You can't issue a code for an alteration that hasn't happened yet, just as you can't change the regs to protect against an epidemic of consumer unit fires that haven't happened yet..... Oh, hang on a minute.
