Evening guys, im looking for a little bit of advice and guidance for my current situation please

I currently work full time as a trainee electrician, and have had this job for the past 6 weeks while studying my 2365 level 2 at college on evenings

what I would like to know, is from your experience with trainees, what would you expect from somebody at my stage of training ? And at what rate would you expect the trainee to be progressing with jobs they are able to do ?

I always try my best, and at the minute my jobs are basically sweeping up and carrying tools, which im fine with

I just want to make sure im doing everything I can to make it worth his while having me as a trainee

Well lads, after my last comment nothing has changed to be honest

Came to the end of last week, and the usual " oh ill sort you out next week sometime if thats ok as im waiting for some cash to come in "

This is not good , mainly for you really , I know a sparks who did the same thing to a mate , he even told the mate he was paying his tax , which he never did and it all backfired , needles to say they are not the best of friends afterwards when it all came to light with the HMRC , if I were you I would seriously look elsewhere for work ,,,,Thats My Honest Opinion anyway ,,, Good look mate,,

At the time I was just happy to be getting experience as I know how hard it can be to get a job as a trainee, but now im starting to look at the bigger picture of tax etc...

Im 26, and hes giving me ÂŁ35 a day

As you say Trev, i probably need to speak to CAB

So guys, a couple of questions please...

Is it legal for me to take cash in hand payments ? And if so who is responsible for paying my tax and N.I ? Im not self employed but dont have any sort of contract with him either..

I think im just going to be better off getting something else on the books to stop all this hassleand messing about !

Hi Matt, if he's not paying it then you are responsible for paying your tax and NI

It's a pity it's not though the books because it's clearly less than minimum wage so you could of had a top up from the jobcentre because you cant live on what he's paying u and pay for your course

Wrong!
If he can reasonably assume that he is an employee then he is not responsible for his own tax and NI. I know this from experience, many years ago I worked for a company who I found out were not paying it over and on consultation with what's now HMRC they went after them. One director spent 6 months as a guest of her majesty and the other absconded to Spain. No bill was presented to me or any of my co-workers.
As he is required to attend at certain times on certain days and is given work that would normally reasonably be given to an employee then his status is clear. There is no way on earth he can be classed as self employed as he does not have the required 3 sources of revenue.

I wouldnt worry about it if its the odd week you will probably just get cash out of his pocket rather than business, so its just as if you didnt work that week.

You been throwing your CV around everyone around here is very busy so im hearing.

I meant if he the employer is saying he's paying the tax and NI then of course he should pay it but if he says he's not paying it then isn't it down to the employee, or only when subbing and self employed?
If he says he is but then didn't of course it's the employer they will chase, but if he says he's not, who's responsibility is it when theirs no contract?
