Yes another EICR question about landlords

Everyone knows about my fight to get RCDs and EICRs monitory.

But here is a question to see if it is already a legal requirement for EICRs!

I know there is no law stating that EICRs must be carried out but there is a law stating the electrical installation must be maintained and in safe working order.

So my question is how do you maintain and ensure that an electrical installation complies with this legal requirement without inspecting it since it was put into operation in the first place?
How do you know that it is still safe and maintained to the standard which is expected?

I did hear that if the property is run as a business it falls into the realms of electricity at work act, Don't know how much water that holds but the penalties if someone gets hurt in the property through poorly maintained electrics is the same. so it could be.
 
Exactly needaspark - rental properties do fall under the electricity at work regs because its the landlords place work site - (a location that generates money for them)
no my fight is not a money maker!

I only asked this question to get the views of everyone - I have asked a few councils and their response was you cant be sure the installation is safe if its not inspected and the landlord wont have any due-diligence in court!
 
I think this sort of falls the same way that BS7671 does, ie. it is not law but we will beat you to death with it should the poo hit the fan.

So even though it is not law, but a recommendation, should something nasty happen and there is no EICR in place then you cannot prove it was safe blah blah.

I think another poster posted something similar in one of the other looong threads in a similar vein to this one.

Another thing to bear in mind Nicholas, is that some of the biggest landlords in the country are the same, or mates with, people who make the laws of the land.

Just checked penalties:

For failure to comply with the Electricity at work Regulations is a fine of upto ÂŁ5,000.00
If the council issued an improvement notice then this increases upto ÂŁ20,000 or upto 6 months in prison (or both).

The problem comes where everyone has a different idea of what is a safe installation - nothing says EICR

I like the way you say that Tony - i am in early discussions with my LA to bring in free MEICRs into all properties in my county - I will make pittance of this, at most it will pay my fuel and calibration of my MFT.

Money - dont think so.

And there;s no monetary value?

Which is exactly what I, and several other posters were trying to get across in nearly 140 posts, in two or more threads !

trev if you have seen my background then you would understand

The MEICR is only to get the LA an idea of how many properties meet the criteria - this will be a one off event which will tell the LA the following:
Who has RCD
Who has bonding
Who has a upto date CU
Who has an unsafe installation.

The landlord will then be able to get the work done or have it ordered that the work is done when the licencing comes in later this year.
Yes of course i will be in the loop and will most likely profit off it some way or another with the landlords getting the work done but that is not the reason for doing it at all!

We have a load of rouge builders around here who are installing Electric, Gas, Windows, etc and not getting any of it notified through BC. We also have a large number of registered sparkies signing off installs they had nothing to do with for a small fee of ÂŁ100. (NOT ME!)
These sparks dont even go on site all results are made up! This is my problem - unregistered DIYers doing work and registered sparks signing it off without even seeing it!

When you have seen the type of work which is subjected to this then you will see why i am doing this!

¼ of 1% out of £1,000,000 isn’t to be sneezed at!

Your not in this for the good of the people, you’re a money grubber!
