Hi need a bit of advice.

Quoted to do some works within a kitchen. I did a day, then I had a sub contractor finish it for me.

I'm domestic installer. I effectively 'designed' the works done and half did the 'construction' whilst first fixing.

My sub contractor 'tested' the works at the end and filled certificate...I then signed all three signatories but as a collective one signature.

This client was appalled I had used a sub contractor, rang the NICEIC and they have written saying that I can't use one.
This is news to me, as I sub all the time to even bigger companies.

Well, this has gone to court and he has used the two emails sent to him by the NICEIC stating I'm breaching protocol.

Am I missing something or can somebody enlighten me????!!!!
 
Tbh, i know on a general level its a no no to sign other sparks'work off but to my naivety i honestly thought it was ok to use a subby whose proved himself time and time again to me to be competent.
blow his mind, get your mate to fill in an iinstallation report, you will your bit in on seperate paperwork and hand both to client.

or to wind him up further just do an eicr on it instead, your not saying you installed his work then
 
I know of a customer who was a bricklayer/building contractor who was a bit slow in coming up with the money to a few men who were subbed in. After several months of ballsing about there was a final phone call made to him.

Men : "Have you got that money for us yet"
Builder: "No i have to see..."
Men: [interrupts]"That's alright whenever you get it give us a shout..... by the way we have your cement mixer, trailer and jeep, you'll get them back whenever you come up with the dough"

The men had their money that afternoon. Was this strictly legal? Probably not. But there was more than ÂŁ150 at stake, I would be inclined to remind the customer that he owes me ÂŁ150 and if he didn't come up with it i'd embarrass him in local pub etc. Although id be tempted to go sparkey joe's route.
 
...It's Friday night,and the advice is amusing,but some of it is of no use,if you have ever been involved in any real debt collection...

My own personal view,is,the OP has made two mistakes,the first was using " a trustworthy" subby,who left a front off...the second was the abusive e-mail.

If this only costs you ÂŁ150,wipe your mouth,and consider it a cheap lesson,a good barrister costing upwards of ÂŁ500/Hr.

For the amounts concerned,you will not educate a truculent customer,and,believe me when i tell you just how fast you would hand over ÂŁ150,to get yer belt and shoelaces back :bobby:
 
as you have his email and basic personal details, sign him up to a few on line dating sites.


he'll get that much grief off his missus, it'll be worth the ÂŁ150.
