some advice needed - used car

Looking for some advice as I know you guys are usually honest and realistic

We Purchased a 2013 Mazda cx5 2.2 diesel from a local dealership in august 2016. 2 weeks ago it broke down with an engine oil pressure light. Cut a very long winded story short, dealership have washed their hands with it (3 weeks out of warranty) and we’ve been told from 2 garages it needs an engine strip down and rebuild because there is swarf in the oil. If you google mazda cx5 engine cam swarf you’ll read about this common fault.


Anyhow we have had no luck from our finance company or dealership who have been nothing but rude and unhelpful and so we have decided to get the engine reconditioned from a company we found online and trade the car in for a new car (new car company has agreed to clear the finance on the mazda) New car is ordered and the mazda is booked in for repair, Happy days.


However the repair company have phoned today to say “sorry but we got the wrong engine information from you and it will in fact be £3400 to repair rather than the quoted £2600”


We was hoping to pay via credit card as this is at least some reassurance if anything goes wrong, however they also said they only accept bank transfer or cash. We are not doing that, it doesn’t seem very legit for a company to only accept those methods of payments.


So we are now looking elsewhere, I’ve found another company in Birmingham to do the work for a price similar to £2600 but the company name “MACC UK LTD” doesn’t bring up much information, however they do accept credit card.


It’s been such a hard 2 weeks or so. My partners been in tears, we are having to car share and ask for lifts for school run etc we can’t afford a hire car.


What advice would you give? What would you do in our situation?

I was wondering if the franchise could be leaned on by Mazda, so that's out the window. So the fault appeared after the warranty expired?

To be honest, I faced a £3000 repair bill for one of my cars a few years ago, so £3400 isn't extortionate. I would go with a repairer you have confidence in. Have you thought about selling the car as is?

Could try CAB, but as the warranty has expired, don't think you'll get anywhere with it, sorry to say. What about asking the franchise doing the repair with some sort of deal.

Sorry to hear of your troubles...

If they only want cash and jam up the price on you then sorry to say those are not good signs. Are you happy they will do a good job? Are there any references? Can you get advice from AA (or similar) ?

As Midwest says, I'd try to get the new car company to eat your old car as is. That way you would have a fixed price and a fixed outcome.

Arrgh I see. See that they are not even considering buying as is?

So your only option is get the car fixed and then bought by the 'new car company', have you asked them if they will buy as is, or don't you want to mention that to them?

If the only way to get it fixed and sold, I would find a local reputable workshop and get it fixed. Once you've sold it to the 'new car company', it's someone else's problem (sorry to say that).

Regardless of it being out of warranty ... If the vehicle has been maintained and it is a known fault ... I would not stop pestering Mazda and the franchise until they sorted it ...

Worth a try, but don't count your chickens. Apparently down to using the wrong oil

There's 1 service that wasn't at Mazda so they say it's not had a full Mazda service history and also it's out of standard Mazda warranty and no one took out any extended warranty.

Believe me we have tried. Phoned Mazda so many times and fed up of phoning warranty. They never ring back and they never want to help.

This is one of life's little joys, just in place to make your life harder.
I would say that you have done all you can at the moment and you are progressing toward a resolution.
Certainly the price increase company is not worth dealing with; stay with the second company so long as you can reliably get the repair done.
Once the repair is complete then you can finalise the replacement car and then try and forget about the past problems.
Because you have already tried Mazda it does seem there is little forward progress, however I would still be pursuing it with Mazda perhaps by letter to allow you to list out the omissions and faults and state what response you are expecting.
If there is a known fault on the car then would this not fall under the not fit for purpose category to allow you to reclaim costs at least.
I wish you luck and I would say that you must try not to let this get you down too much, it is a car, even though it has caused major problems try and put it into the closed file of "life's hells".

Do you not have a decent local independent garage or engineering shop you could have the work done with taking it away from Mazda? Touch wood I have never had a major issue with a car but would not be taking it into a Mazda dealer but opting for a trusted and recommended local repairer, with new cars out of warrantly I take mine to a local VW/Audi specialist as I trust them more. I agree that sometimes it is best just to bite the bullet get it done and then get rid of it. Will the Mazda garage put in writing that the cause of the fault is the previous garage using fully synthetic rather than semi synth oil, if they will and state this is what has caused the problem then that is where your claim lies, do you have legal expenses insurance, if so get advice on this aspect? Unfortunately a few hours out of warranty is enough for them to wriggle.

You are correct, for a car of that age , and the retail value ,that is an unreasonable time to have had a major failure . It could be successfully argued that it is not fit for purpose.
Take it up with trading standards , the garage will not want them involved.

Spoke with trading standards and the legal advice line from the caravan club which we are members, they've all said the same thing, we need to go through the finance company. The problem is the finance company won't do anything because it's over 6 months, unless we get a mechanical inspection done and it's proven the fault was on the car at the time of purchase. It's £200 for this report and it's impossible to prove the fault was there when we purchased the car
