Hi need a bit of advice.

Quoted to do some works within a kitchen. I did a day, then I had a sub contractor finish it for me.

I'm domestic installer. I effectively 'designed' the works done and half did the 'construction' whilst first fixing.

My sub contractor 'tested' the works at the end and filled certificate...I then signed all three signatories but as a collective one signature.

This client was appalled I had used a sub contractor, rang the NICEIC and they have written saying that I can't use one.
This is news to me, as I sub all the time to even bigger companies.

Well, this has gone to court and he has used the two emails sent to him by the NICEIC stating I'm breaching protocol.

Am I missing something or can somebody enlighten me????!!!!
 
I undestand those concerns, i would never sign sombody elses work off. And insist it must be a eic.
So basically you are saying he just did the testing and you signed it off. Could you not just fill in a 3 part EIC, you for design, you for construction and your mate for insp and test? NICEIC firms have QS's sign off jobs they have never been within 100 miles of, that happens every day. Storm in a tea cup.
 
Without trying to sound like im back tracking, as i can see everyones point and have probaly made a mistake doing this...Despite this i went back and carried out full tests again in front of client and issued new certificate. The main issue is that the nic said i cant use a subby at all.

ha!! how hypocritical of the NICEIC with their QS system!! Also, how dare the NICEIC say who you can use, it is YOUR business.

Scornio can you start again and say exactly what you did and who signed what just so were all clear!! and also what were the customers original complaint.

why did you even tell them he is a sub contractor, just inform them that you cannot make it & send one of your team to finish job they don't need to know anymore, also as long as you have checked his credentials ie public liability all his qualifications & have worked with them before who would ever know.
I work on site as main electrical contractor & I use subsides & so does everybody what difference is there none & you could have used this guy for 10 years no one has a clue

The QS is signing to ensure that the results of inspection and testing are properly recorded on the correct forms and has reviewed and confirmed the results to be acceptable.

what is customer complaint exactly as there may be nothing wrong with any of your works or subbies you have certs, if NICEIC are that concerned get them to check out works & if all results are ok & no problems then there is no issue, say if you had done all the work & there was a problem & you were reported to NICEIC you would have your results & they would have to get it tested to prove you were at fault or not so what is the issue ?
 
Ok, so i am domestic installer.

I did a days work and had my subby do the last two days.

My subby made a couple of mistakes by forgetting to put a cover plate back on...mistakes happen. After asking the clie t if he was happy with work which he wasnt and explained why, i said immediately i would come round and put right anything which wasnt.

Instead he didnt and went straight to the niceic and after a month of asking him to let me in, the niceic told him he had to in order for myself to issue certificate and finalise work. During this process he wrote to the nic and they told him i cant use a subby.

I had the certificate my subby had filled in with me but to put the client mind at ease i said that i would carry out test again to prove my subby tested out ok, which they did. I then signed if front of him once job was complete.

Small claims?

If the "Court" find in their favour and the installation is compliant the worst that can happen is the O.P would have to pay Court costs and possibly retesting costs by others.
It certainly won't mean the customer doesn't have to pay anything for the satisfactory work done.
